Terms of Sale
"www.canadacloudpharmacy.com" is (the "Website", "canadacloudpharmacy.com") site owned by Canada Cloud Health Inc., a referral service, which authorizes, for the provision and sale of products and services, the licensed pharmacy, Cloud Pharmacy, located at 4918 Victoria Drive,Vancouver,BC, V5P 3T6. The following terms and conditions (the "Terms of Sale") are in relation to the sales and services between Canada Cloud Health and the authorized Pharmacy (the "Pharmacy") and you (the "Customer") for the products and services (the "Products") offered by the Pharmacy. Upon placing an order of the Products detailed on a purchase order (an “Order”) the Customer agrees to and accepts the Terms of Sales. Canadacloudpharmacy.com is a Canadian business registered in the Province of Vancouver, British Columbia, Canada. Customers are purchasing medications and products approved for sale in Canada. Any and all disputes, claims or controversies that arise out of the sale, delivery, use or misuse of any product or service shall be submitted and be subject to the jurisdiction of the courts of the Province of British Columbia, Canada. The final adjudicate in determining any suit, action or proceeding from or in connection to the Pharmacy must be made in the courts of the Province of British Columbia with reference to British Columbia laws. These terms of sale may not be amended, supplemented or altered in any way by a Customer document. Term of sale are subject to change at any time without prior notice.
1. Power of Attorney
The Pharmacy shall be authorized and appointed by the Customer as its attorney and agent, to sign all documents, take all steps and act on behalf of the Customer as if the Customer is personally present and acting for itself for the purposes of obtaining a legally valid prescription for any prescription the Customer has sent to canadacloudpharmacy.com or to Cloud Pharmacy and packaging and delivering the Customer's prescription. This Customer authorization shall include, but is not limited to, the gathering and compiling of personal and health information and disclosure of such information to canadacloudpharmacy.com the Pharmacy, the physician and any other healthcare professionals being retained, as required, on behalf of the Customer.
You authorize and appoint the Canada Cloud Health and Cloud Pharmacy as your agent and attorney, to take all steps, sign all documents, and act on your behalf as if you were personally present and acting for yourself for the limited purposes of obtaining a legally valid prescription, if required by applicable law, for any prescription which you have sent to Cloud
This authorization shall continue until the Customer revokes it. The Customer may revoke the authorization at any time.
2. Prescription Required
It is necessary for a customer to deliver the Prescribing Practitioner’s prescription to canadacloudpharmacy.com or for the prescription to arrive from the Prescribing physician’s facisimile or electronic mail in order for the customer to place an order with canadacloudpharmacy.com.
3. Personal Examination
The customer must have seen a Doctor within the last 12 months and have received a prescription for said medication to be ordered, if said medication requires a prescription.
4. Privacy Policy
It is essential that the customer shall disclose accurately and fully information regarding their personal health and consent to its use by canadacloudpharmacy.com. On placing an order a Customer consents to canadacloudpharmacy.com Privacy Policy and the use of collected personal information. canadacloudpharmacy.com reserve the right to change their Privacy Policy. The Customer must agree to review the Privacy Policy on the submission of any order.
5. Products and Services
canadacloudpharmacy.com may change or discontinue the Products and Services offered any time, without prior notice.
6. Orders; Prices; Payment Terms
Prices for any product are subject to change without prior notice. Credit terms are within the sole discretion of canadacloudpharmacy.com’s payment options include, but not limited to CREDIT/DEBIT card, CHEQUE or MONEY ORDERS (made out to ‘Cloud Pharmacy Inc'), or electronically using ACH (Automated Clearing House). If the client chooses cheque or money order, the balance on the account must clear prior to the order being successfully completed.
7. Shipping Charges; Taxes
The Customer is the responsible party for any good and services tax or any other tax associated with the purchase and delivery of their order.
8. Shipping
The Customer acknowledges possesion of the medications from the authorized pharmacy in British Columbia. The Pharmacy acting as attorney for patient, will arrange for delivery of their product to an address chosen by the customer. All ship dates and shipping durations are estimates. canadacloudpharmacy.com will not be responsible for any damage to the Customer due to failure of the product to arrive within the estimated shipping duration or any delays in shipment.
9. Exports
The customer acknowledges that the Products sold are subject to applicable export and import control laws and regulations. The Customer represents that sale, delivery, and shipment of the Products will not violate any import, export, or other law or regulations in the Customer’s home jurisdiction when and by placing an Order for product or services. All products sold by Cloud Pharmacy are approved by Health Canada, Canada's food and drug administration. If importing into the USA, the FDA does not recognize Health Canada approved products and may consider any medication sold by us in violation of their importation rules. The FDA may or may not consider your purchase as an allowable exception for importation under the personal drug importation exemption, as such you maybe contacted by the FDA for clarification or notification regarding your purchase.
10. Return Policy
Canada Cloud Pharmacy is a licensed Canada Pharmacy and in order to protect all parties involved, prescription products cannot be returned for any reason. All sales are final. Please consult with your physician, or our pharmacist, before completing your order if you have any questions regarding your medication.
11. Warranties
All warranties are the sole responsibility of the manufacturer of the purchased product. canadacloudpharmacy.com disclaims any warranties and conditions for any and all products or services to the maximum extent permitted by law. Any claim in respect of products is limited to the replacement of said product.
12. Force Majeure
canadacloudpharmacy.com shall not be liable for any failure to deliver products or services caused by circumstances outside their immediate control; these include but are not limited to mail delays, lost mail/packages, delays in shipping due to out of stock items or backlog of orders to fulfil a particular product, customs delays etc. canadacloudpharmacy.com are not liable for any damages caused to the product from shipping or any other damages arising from loss of profits, loss of business, personal injury or death or other loss or damage caused either directly or consequentially through the purchase or usage of products services from canadacloudpharmacy.com. canadacloudpharmacy.com are not responsible for notifying customers of any delays in shipments. If required, the customer has the responsibility of purchasing an alternative product(s) and all costs incurred.
13. Entire Agreement
The Customer agrees that these Terms of sale shall govern in the event of any conflict between these terms and any other terms whether written or oral, between the Customer and the Pharmacy.
14. Severability
Any invalid or unenforceable provision of these Terms shall not affect the validity or enforceability of any other provision included in these Terms of sales.
15. Knowledge and Consent
By placing an order with canadacloudpharmacy.com, the Customer has read and understands the terms and conditions as set out herein. The Customer represents that he/she consents to the Terms of Sale, and does so with full knowledge and without undue influence or duress. The Customer acknowledges that the Terms of Sale are readily accessible on a 24-hour basis from the canadacloudpharmacy.com website. The Customer acknowledges having had every opportunity to obtain independent legal advice with respect to the Terms of Sale.
